Terms of Service

1. Publisher and Purpose

Adwise is published and operated by Levantys by Daviet, a Swiss sole proprietorship, with its registered office at Bâtiment Alto, Esplanade de Pont-Rouge 9A, 1212 Grand-Lancy, Switzerland, registered under Swiss business identification number IDE CHE-393.841.690.

These Terms define the conditions under which you may access and use the service. They apply to clients located in both Switzerland and France.

2. Service Description

Adwise is a marketing analytics platform integrating generative artificial intelligence technologies. The service uses large language models (LLMs) provided by third parties to generate analyses, answers and recommendations based on your data. Responses provided by Adwise are generated automatically by artificial intelligence and do not constitute certified professional advice. The service is provided "as is" and may evolve. We may add, change or remove features at any time.

3. User Account

Using the service requires creating an account. You agree to provide accurate information and keep it up to date.

You are responsible for keeping your credentials confidential (including two-factor authentication) and for all activity carried out from your account. The service is intended for professional use by individuals aged at least 16.

4. Connecting Third-Party Platforms

By connecting a third-party account via OAuth, you authorize Adwise to access, on a read basis, the data covered by the permissions you grant, solely to provide the service.

You represent that you hold the necessary rights over the accounts you connect. Use of those platforms remains subject to their respective providers' terms and policies. You can disconnect a platform at any time.

5. Acceptable Use

You agree not to:

• use the service for illegal or fraudulent purposes;
• attempt to compromise the security or integrity of the service;
• reverse engineer, copy or automatically scrape parts of the service;
• overload the infrastructure or circumvent usage limits;
• use the service on behalf of a third party without authorization.

6. Subscriptions, Pricing and Payment

All or part of the service may be offered as a paid subscription. The applicable prices, duration and billing and renewal terms are communicated to you at the time of subscription.

Unless otherwise stated, subscriptions renew automatically for an equivalent period and may be cancelled before the term according to the terms shown in your account.

7. Right of Withdrawal (Consumers)

Where the client is a consumer residing in the European Union (in particular in France), they have a statutory withdrawal period of fourteen (14) days from subscription, without needing to give a reason.

However, if you request performance of the service before the end of that period and the service is fully performed, you acknowledge waiving your right of withdrawal for the performed portion. This right does not apply to business clients.

8. Intellectual Property

The Adwise platform, its software, trademarks, content and graphic elements are the exclusive property of Levantys by Daviet or its licensors. No rights are assigned under these Terms, other than a personal, non-exclusive and non-transferable right of use.

You retain full ownership of the data and content you upload or generate. You grant Adwise a limited license, strictly necessary to process that data to provide the service.

9. Personal Data

The processing of your personal data is described in our Privacy Policy, available at https://adwisehub.com/en/privacy-policy, which forms an integral part of these Terms.

10. Artificial Intelligence and Transparency

Adwise integrates generative artificial intelligence technologies provided by third parties (notably Anthropic and OpenAI). The responses, analyses and recommendations you receive are generated automatically by these models from the data in your connected accounts.

Data transmitted to AI models to generate your responses is not used by model providers to train or improve their systems. Data is processed in accordance with the model providers' data processing policies, under professional API contracts.

You acknowledge that AI-generated content may contain inaccuracies, errors or incomplete information. Adwise does not guarantee the accuracy, completeness or relevance of generated responses. You are solely responsible for verifying information and for decisions made on that basis.

Adwise may change the AI models used, providers or technical configurations at any time, without notice, in order to improve service quality.

In accordance with Regulation EU 2024/1689 (AI Act), Adwise clearly and accessibly informs you that you are interacting with an artificial intelligence system.

11. Service Availability

The service is provided as a decision-support tool. Analyses and recommendations are generated automatically by artificial intelligence models from data obtained from third-party platforms. We do not guarantee the accuracy, completeness or relevance of AI-generated responses. The results provided do not constitute professional, financial or legal advice under any circumstances.

12. Liability

The service is provided as a decision-support tool. Analyses and recommendations are generated automatically from data obtained from third-party platforms, the accuracy and completeness of which we do not guarantee. You remain solely responsible for the marketing decisions you make.

To the extent permitted by applicable law, Levantys by Daviet shall not be liable for indirect damages, and any liability is limited to the amounts actually paid by you for the service during the twelve (12) months preceding the triggering event.

13. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate your access in the event of a breach of these Terms.

Upon termination, your data is handled in accordance with our Privacy Policy.

14. Changes to the Terms

We may amend these Terms. In case of a significant change, you will be notified and the last-updated date shown at the top of this page will be updated. Continued use of the service constitutes acceptance of the amended Terms.

15. Governing Law and Jurisdiction

These Terms are governed by Swiss law. The competent courts are those of the registered office of Levantys by Daviet, subject to applicable mandatory provisions.

Where the client is a consumer domiciled in France, they additionally benefit from the mandatory provisions of French consumer law and may bring proceedings before the courts of their place of residence.
